Fair Use Guidelines for Using Copyrighted Material

There are situations where the use of copyrighted materials is fair and appropriate. Here is a guideline.

The Copyright Act of 1976 contains the following statement in 17 U.S.C. Section 107:

*107: Limitations on exclusive right: Fair use. Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is NOT an infringement of copyright.
The Copyright Management Center of Indiana University-Purdue University at Indianapolis website is a good resource regarding how state institutions establish "fair use" guidelines, and about how state institutions may be immune from copyright liability. The information here is based on a recent court decision in Texas. In addition, this website provides a number of useful links to further information.
