UTD & the Americans with Disabilities Act

Title II of the Americans with Disabilities Act of 1990 (ADA), extends the nondiscrimination requirements of Section 504 to all actions of state and local government entities, regardless of receipt of federal funding.

An individual with a disability is considered, under the law, to be one who:

  • Has a physical or mental impairment that substantially limits one or more major life activities;
  • Has a record of such impairment; or
  • Is regarded as having such an impairment.

The ADA requires reasonable accommodation for students and employees with disabilities when such accommodations would not impose "undue hardship". Reasonable accommodations enable students and employees with disabilities to enjoy benefits and privileges of employment equal to those enjoyed by similarly situated non-disabled employees.
